1. Responsible for the processing of personal data.
Portaltop Spain, S.L., with address in Alicante, Calle Portugal nº 8, mezzanine, right (03003), and with NIF B-72583560 ("Portaltop") is responsible for the treatment of the personal data that you send through our web page or our applications ("Web and Apps"). This Privacy Policy describes how we collect, use, store, share and protect the personal data that you provide to us as a User through the public and private areas, as applicable, of the websites and apps, to search for information about published properties or to publish a property yourself, whether you hire our services as an individual, as a freelancer or as a representative of a commercial company.

The applicable regulations are the European General Data Protection Regulation 679/2016 ("RGPD") and the Organic Law 3/2018, on Personal Data Protection and guarantee of digital rights ("LOPDGDD").

Remember that, as a user, you must guarantee the authenticity and veracity of all personal data that you communicate or provide through the Website or the Mobile Application, which you must keep updated as you will be responsible for the damages arising from the inaccuracy or falsity of the same.

2. Type of data we process on the website and application

We process your personal data in order to provide you with the services you have requested through your interactions on the Website and Mobile Application. 

Such personal data that we process, by way of example but not limited to, may be: 

      -Identifying data: name and surname, identity document (ID card/passport/NIE), profile picture, signature, user identification and password.
      -Biometric data: stroke, pressure and speed of the electronic signature.
      -Contact data: telephone number, e-mail and address for notification purposes.
      -Personal characteristics: age, gender, profession.
      -Economic and financial data: data of your card or bank account and your address for billing purposes, when you hire a payment service.
      -Interaction and navigation information: interaction and navigation on the Web and Apps, and IP address.
      -Data related to the services you contract: complete information of the properties you are going to advertise and information derived from the contracted service.
      -Information that particularly affects Professional Clients (legal entity): in case you hire any of our services as a legal entity, we will treat the following information related to the representative(s): name, surname(s), DNI/passport/NIE, telephone, contact email and, in some cases, documents proving their representation.

3. Purposes of data processing and legal legitimacy for its treatment.

In Portaltop we will treat your data for the following purposes:

3.A) Processing necessary for the provision of the services requested.

There are a series of data that we request as "mandatory", because they are necessary to provide the services you request.

As for the list of those services that we offer you, they are included:

      -Registration as a Registered User on the Web and Apps. Please note that this implies the sending of any transactional communication related to its operation or the operation of any other contracted service. Account and profile configuration
      -Service to save and manage your searches as a User, whether you are registered or not.
      -Service to publish ads on the Web and Apps and, unless you tell us otherwise, in other portals owned by Portaltop, where it is also responsible for the processing of your data. In addition, we will process your data to issue invoices for services rendered, if any.
      -Through our platform you will be able to contact directly with the advertisers, in such a way that the personal data and the information that you include in the contact form will be provided to the advertiser. 
      -Service of sending alerts to inform you of the publication of ads that match the search preferences that you have saved.
      -Instant messaging service between users to facilitate the transaction and communication between them. By using the contact form or chat in the user area, you will be using our messaging service.
      -Requesting the support service from a real estate expert who will help you buy, sell or rent a property.
      -Sending important and necessary communications related to the provision of our services, including sending reminders, technical notices, updates, security alerts, support messages, among others. 
      -Monitoring compliance with the terms and conditions of the website.

Please note that, if you have requested these services, we will use your identification data, financial data (if they are paid services) and the information, if any, we have about your property. In addition, we will use your contact information to communicate with you by phone, SMS or email when necessary for the provision of such services.

For the contracting and provision of some services, it will be necessary for Portaltop to share your personal data with third party companies, so that they can attend your request and provide you with the service. For these additional services, we will use your identification and contact information, as well as the information we have about your property.

3.B) Treatment necessary for analytical and statistical purposes.

      -Elaboration of statistical reports about your user profile based on your access habits and the activity developed on the Website and the Mobile Application, if applicable, in accordance with our cookies policy, in order to develop and improve the operation of Portaltop. 
      -Improve the services to which you subscribe and Portaltop features by studying your behavior as a user. 

3.C) Processing for marketing and market research activities.

      -Elaboration of a commercial profile based on the information provided by you, in order to carry out commercial actions adjusted to it, by any channel, using your personal data derived from the management of the contracted products as well as navigation data, access habits, traffic, etc. No automated decisions will be taken on the basis of this profile that produce legal effects for you or that significantly affect you in a similar way. On the other hand, your commercial profile may be used by third party sites to show you personalized advertising.
Sending communications and newsletters to inform you of our products and services, as well as Portaltop news, recommendations and offers to improve the visibility of your ads, multiply the visits to your ad and contacts received, based on our legitimate interest to maintain business contact with you unless you tell us otherwise.
      -Sending personalized communications, through different channels, about products and services of third parties that may be of interest to you based on your profile, such as offers and promotions related to any of the following sectors: Financial, Publishing, Education or Training, Employment, Automotive, Telecommunications, IT, Technology, Home, Beauty, Real Estate, Distance Selling, Consumer Goods, Textile, Food, Collectibles, Audiovisual Content, Music, Hobbies, Leisure, Travel and Tourism, Insurance, Energy and Water, NGOs and services provided by the public administration.
      -Sending push alerts about Portaltop's news and recommendations.
      -Sending satisfaction surveys in relation to the services provided and the analysis and processing of the information resulting from such surveys, including the possibility of contacting you in relation to the answers you voluntarily answer and provide us with, for reasons of quality and improvement of our products and services. The legitimate basis will be the legitimate interest

In the present case, Portaltop will request a specific consent for each of the purposes we have just indicated. In particular, in the case of commercial communications, if you are a Registered User, you will provide us with this authorization by checking the box that appears on the registration or registration form of your ad and that is displayed in the "Settings" section.

3.D) Compliance with legal obligations.

To comply with the obligations established in the regulations, including the attention of the exercise of the rights of the interested parties recognized by the applicable regulations, all of this, to comply with the different legal obligations that may be required of us and if we are requested by any Court or Tribunal, the State Security Forces or any other competent Public Authority or Administration. If necessary, we will use your information as required so that we can comply with our legal obligations.

4. Data retention period

We inform you that, as long as you are a user of Portaltop and use our services, your data will be kept for the duration of the contractual and commercial relationship with us. In those cases in which the processing of your data is based on your consent, until you revoke it. In the cases provided for by law, we will process your data until you request the deletion of the same, without prejudice to the fact that the data will be retained by us for the time necessary to comply with our legal obligations and the deadlines established by law.

Throughout the retention period, appropriate security measures are implemented to prevent any risk of destruction, loss, accidental alteration or unauthorized access to your personal data. Likewise, we inform you that, before your personal data is deleted in its entirety, it will be kept blocked at the end of the processing for which it is intended and during the periods of limitation of obligations defined for each purpose of the processing, for the sole purpose of responding or complying with possible liabilities arising from the processing.

If you are a Private Customer who has used the property publication service, whether free or paid, and you request the deletion of your data, including your telephone number, we inform you that we will keep this telephone number blocked (i.e. encrypted and associated with an internal identifier) for a maximum period of 2 years from the last of your publications, in order to prevent improper and/or fraudulent use of our free publication service. During this period, we may carry out security checks to ensure the correct use and operation of our services.

Also, if you are a Professional Customer, we inform you that we will keep your phone number for a maximum period of 4 years since your last interaction with Portaltop, in order to prevent misuse and/or fraudulent use of our services.

5. Recipients of personal data

We may communicate your data to third parties in the following cases:

      -To facilitate interactions within the Portaltop platform, when you decide to contact another Portaltop user, your personal contact details will be communicated to the advertiser indicated in the detail of each ad to enable contact with the latter.
      -In those cases in which you request the help or advice of an expert or real estate agency, external to Portaltop, we will proceed to transfer your data to those that you determine, always with your prior consent.
      -To carry out our business, we use certain trusted suppliers and services that may access our systems in order to provide services to us or to provide services to you on our behalf. These suppliers have a contractual obligation to protect your personal data with the maximum possible guarantees and may only access them in order to carry out the services contracted by Portaltop. In some cases, these providers are established outside the European Economic Area, which may imply that your data may be subject to an international transfer. In these cases, personal data will be protected by the service providers through the adoption of appropriate measures and/or by signing the European Union standard contractual clauses on data transfer approved by the European Commission, ensuring a level of protection equivalent to the European one.
      -We may disclose your personal data to public bodies, law enforcement agencies, courts and tribunals, tax authorities and regulatory bodies when required to do so in accordance with legal and regulatory provisions, when necessary to comply with our legal obligations or with a legally binding request/request and in cases where it is necessary to respond to cases brought against Portaltop.

6. Rights of the interested parties

We inform you that you may exercise the following rights:

      -Right of access to your personal data to know which are being processed and the processing operations carried out with them;
      -Right to rectify any inaccurate or incomplete personal data;
      -Right to access your personal data, as well as to request the rectification of inaccurate data or, where appropriate, to request their deletion when, among other reasons, the data are no longer necessary for the purposes for which they were collected.
      -The right to request the limitation of the processing of your personal data when the accuracy, legality or necessity of the data processing is doubtful, in which case, we may keep them blocked for the exercise or defense of claims.
      -Right of opposition to the processing of your personal data, when the legal basis that enables us to process it is our legitimate interest. Portaltop will stop processing your data unless it has compelling legitimate reasons or it is necessary for the defense of claims.
      -The right to data portability, as well as to withdraw the consents provided at any time, without affecting the lawfulness of the processing based on the consent prior to its withdrawal.
      -The right to revoke the consent given at any time.

If you wish to exercise any of your rights, you can contact us through the emails indicated in section 1, through the links provided in Portaltop's emails and communications, or by accessing your profile in your user account. Alternatively, you can also contact us by mail at the address set out in point 1, addressed to Customer Service and indicating on the envelope "Data Protection". In order to process your request without delay, please remember to clearly provide as much information as possible about your request: name and surname, e-mail address you use for the account or portal that is the subject of your request. In addition, we remind you that the exercise of these rights is free of charge.

Finally, we inform you that you can address to the Spanish Data Protection Agency and other competent public bodies for any claim arising from the processing of your personal data.

7. Confidentiality and security

Portaltop uses all reasonable efforts to maintain the confidentiality of personal information processed through the Web and Apps and, where appropriate, other tools. We maintain strict levels of security to protect the personal data we process against accidental loss and unauthorized access, processing or disclosure, given the state of technology, nature and risks to which the data is exposed. However, we cannot be held responsible for your use of the data (including username and password) that you use on portaltop outside our tools, Web and Apps.

8. Cookies

Portaltop uses cookies and other similar technologies on its Web Site and Mobile Application. This software and/or third party services collect information while you browse or interact with the content of our Website and Apps or of companies affiliated or participated by portaltop, as well as information about the device you use.

The main purpose of collecting the information generated by cookies is to learn more about how you use and interact with the Web and Apps to improve your experience while using our services and to identify possible errors in the implementation of our Web and Apps. The information collected includes, among others:

      -The IP address of your device.
      -The screen size of the device you are using.
      -Device type (unique device identifier) and browser information.
      -Geographic location.
      -Favorite language used to display on our website.
      -Pages visited.
      -Date and time the pages have been visited.
